In the 41 year of King Henry the 3d. Elyas Biſhop, the High Prieſt of the Iews, as †Hiſt. Angl. p. 888. See my firſt Demurrer. p. 28.Mat. Paris ſtiles him, for a certain Tranſgreſſion againſt the King, and his Brother King of Almaine, was judicially deprived of his High-Prieſthood and Prieſtly Office, by the judgement of the Kings Juſtices aſſigned for the cuſtody of the Jews in the Exchequer, and of all his other Offices formerly granted him by the King; and that he ſhould never be capable to receive or execute theſe Offices again: whereupon the King for a Fine of 3 marks of gold paid by the Commonalty of the Jews, granted unto them by his Charter, that from thenceforth none ſhould be their Prieſt, but by the common election of the ſaid Commonalty of the Jews; and that upon the death of every Prieſt, they ſhould have free Liberry to chuſe another Prieſt, and of preſenting him to the King, that he might obtain his aſſent and ſavour therein; as this memorable record informs us, wherein the names of the Juſtices aſſigned to the Iews are ſpecified.

Cum Elyas *Epiſcopus here, I conceive to be a ſurname, as Le Eveske, the ſame in French, and Biſhop then was, & at this day is both amongſt the Jews, French and Engliſh, not a name of Office, as is generally miſtaken. In cujus, &c. Teſte Rege apud Wodſtoke, 20 die Iulii.
I obſerve in this Record, that Elyas, is ſtiled, only, Sacerdos, not Presbyter Iudeorum his only Prieſtly office called, Sacerdotium communitatis Angliae. & Sacerdotii officium; not Presbyteratus omnium Judeorum totius Angliae, as *Here f. 3.23. b.Jacobs and Aarons forementiontioned Offices are. And he that ſhould ſucceed him by common election, is ſtill here ſtiled Sacerdos, Sacerdotis, Sacerdotem, thrice together, not Presbyter at all: Therefore certainly theſe offices were diſtinct, the one eccleſiaſtical, the other temporal in the Exchequer only as I formerly manifeſted.
What Elias his offence was, for which he was thus deprived of his Prieſthood, is not expreſſed in the record, but moſt probably it was his ſtout & bold ſpeech to the King, Earl Richard and the Lords, in behalf of the Jews the year before, when they exacted an intollerable tax from them under pain of a moſt loathſom priſon,*Pag. 28.29. hanging, and an ignominious death, recorded at large by *Hiſt. Angl. p. 887.902.Matthew Paris and in the firſt part of my Demurrer, which I ſhall not repeat, What power the King and his Juſtices then had over their Iewiſh Biſhop, & Prieſts themſelves is ſufficiently evident by this Record.
